Voter Roll Case Sent Back To NEC

The case before the Supreme Court involving the National Elections Commission (NEC) and Mulbah S. Jackollie, a senatorial aspirant of Margibi County, has finally ended, with the voter roll remaining in full swing while the NEC is to define the matter if need be.

   According to the court’s ruling, the Alternative of Mandamus issued is confirmed, the preemptory Writ of Mandamus granted and the stay order imposed on the publication of the respondent.

   The ruling noted that the contestant roll remains in full force, pending a final determination of the case, and the respondent ordered to conduct a hearing into the petition’s complaint and make a determination therein.

   The judge ordered the Clerk of Court to send a mandate to the respondent, NEC, to give effect to the ruling.

   In October, the Justice in Chambers of the Supreme Court placed a temporary stay order on the preparation of the senatorial listing until the petition for the writ of mandamus filed by the lawyers of Jackollie, led by Dr. Cllr. Jallah A. Barbu, was determined.

   Justice in Chambers, Sie-A-Nyene Yuoh, on October 22, 2020, confirmed the alternative writ earlier issued, and granted the alternative mandamus.

    “The stay order imposed on the publication of the respondent’s contestant roll remains in full force and effect, pending a final determination of the case,” Justice Yuoh’s ruling noted.

   She then ordered the NEC to conduct a hearing into Jackollie’s complaint and make a determination.
