“Bogus, Fake And Insufficient”; CSNL Describes Cllr. Johnny Momoh’s Criminal Appearance Bond

The Civil Society Network of Liberia (CSNL) has described as bogus, fake and insufficient the surety bond filed by Cllr. Johnny Momoh in the case, “Republic of Liberia by and thru Marie Nallon vs Cllr. Johnny Momoh and others”, brought against him by Marie Nellon at the Brewerville Magisterial Court, and calls for his immediate arrest. On March 27, 2024, the Brewerville Magisterial Court issued a criminal writ of arrest for Cllr. Johnny Momoh and others on charges of burglary and theft of property based on oath of complaint filed by Marie Nellon.

  After a careful review of the case, “Republic of Liberia by and thru Marie Nallon vs Cllr. Johnny Momoh and others”, the Civil Society Network of Liberia (CSNL) say they see the surety bond filed by Cllr. Johnny Momoh asbogus, fake and insufficient. “The criminal appearance bond filed by Medicare Insurance Company in favor of Cllr. Momoh is greatly deficient and unsatisfactory, because it lacks the financial requirements to serve as security for the said Criminal Appearance Bond. The available balance of 429,746.99 on the bank statement of Medicare Insurance Company is far below minimum financial requirements for providing security for a bond penalty of US$1,500,000.00,” the CSNL said in a press release.

  “Additionally, the CSNL sensed foul play into circumstances and the period in which Cllr. Momoh filed the criminal appearance bond. We wonder how could the Issuance of the criminal appearance bond coincide with the date the writ of arrest was issued by the court. This has the proclivity to undermine the independence of the Brewerville Magisterial Court under Magistrate Ernest F.B. Bana. We urge Magistrate Bana to remain as judicially independent as possible, and ensure that justice is served.  

  “The Civil Society Network of Liberia has reliably gathered that Madam Nellon, who earlier agreed to an out-of-court settlement, decided to file for crimes of burglary and theft of property against Cllr. Momoh because he grossly failed to exercise remorse and do a restitution of Madam Nellon’s lost cash and properties. On April 8, 2023, Cllr. Momoh allegedly broke into Madam Nellon’s house and threw her things outside. This disgraceful action led to the loss of jewelries valued at US$500,000.00 and cash amount of US$75,385.000, plus L$80,000.00, amounting to the total of US$575,385.00 plus L$80,000, which was Madam Nellon’s hard-earned business money and jewelries. With heart of evil and wickedness, Cllr. Momoh has refused to pay back Madam Nellon’s properties and money. As such, it was compelling for her to use the law in ensuring that she gets justice through the restitution of her properties and money.”

  The Civil Society Network of Liberia then urgedMagistrate Ernest F.B. Bana to set aside the fake and unsatisfactory criminal appearance bond filed by Medicare Insurance Company and go ahead to arrest and detain Cllr. Johnny Momoh and fellow defendants until a valid bond is filed according to law. “Cllr. Momoh has brought so much emotional, psychological and economic abuse and pain on Madam Marie Nellon. Therefore, this Liberian Woman deserves justice. We believe that Cllr. Momoh has sensed his guilt, and must be made to pay for it. We call on Magistrate Ernest Bana to expeditiously dispense justice in favor of Madam Marie Nellon,” CSNL disclosed.
