Supreme Court Finally Declares Foko Winner of D-9

The Supreme Court has finally declared Frank Saah Foko as winner of the December 8, 2020 by-election conducted in district #9, Montserrado County.

  The Counselors (appellant) for the Friends of Foko (FoK) was Cllr. Moiffie Kann, while Cllr. J. Augustine Toe  and Cllr. Peter W. Howard  represented the NEC on March 2, 2021.

   According to the ruling of the Supreme Court, the complaint, purported by the Secretary General of the Collaborating Political Parties (CPP), did not proffer the authorization from the CPP to file the complaint, neither did he sign the letter of complaint.

    The Supreme Court stated that the letter of complaint was signed by an unknown person supposedly acting for him, and that the unknown person himself was never authorized and his identity was not known.

   The NEC stated that no officer or official of the CPP could testify to the unknown person and, therefore, the NEC finally stated that, in the absence of evidence that the person who authored the letter of complaint was indeed doing so for and on behalf of the CPP, the complainant did not establish legal standing to file the complaint on behalf of the CPP.
